UAE Employee Wins Dh1.33 Million Salary Case

ABU DHABI: In a landmark ruling, the Abu Dhabi Court of Cassation has overturned a previous decision requiring a female employee to repay Dh1.33 million in salaries received during an 18-month absence.

The court awarded her Dh103,665 for unused leave and notice period pay.

The employee, who had worked with the company since February 2014, filed a labor claim after her termination in October 2024, alleging wrongful dismissal.

Her original request included unpaid wages and compensation for arbitrary dismissal among other claims.

Initially, the Court of First Instance awarded her a portion of her claim but upheld the company’s counterclaim for repayment of the salary. After her appeal was rejected by the Court of Appeal, she escalated the case to the Court of Cassation.

The top court found significant errors in the handling of the case by lower courts, noting that they had failed to consider key evidence, including a medical certificate confirming her leave.

The court ruled that employees should not be penalized for administrative mistakes, especially when they have acted in good faith and provided valid documentation.

This decision highlights the importance of proper legal procedures in employment disputes, reinforcing that employers must substantiate their claims with adequate evidence.

The ruling not only protects the employee’s rights but also sets a precedent for future cases in the UAE labor market.
