UAE: How to Navigate Resigning During Your Probationary Period

In the UAE, employees on probation should be aware of the regulations governing resignations during their first six months of employment.
Under Federal Decree-Law No. (33) of 2021, probation periods cannot exceed six months, and specific conditions apply for those wishing to leave their jobs.

If an employee intends to switch jobs within the country, they must notify their current employer at least one month in advance. Alternatively, they can compensate their employer with an amount equal to their wage for the notice period.
For those looking to resign in order to leave the UAE, a notice of at least 14 days is required, or they must provide compensation equal to their full wage for the notice period.
Failing to comply with these requirements may result in the employee being ineligible for a work permit in the UAE for one year after departure.
These regulations aim to protect employers’ rights while enhancing labor market flexibility and competitiveness, according to the UAE Ministry of Human Resources and Emiratisation.
