UAE Personal Status Law 2025: Key Reforms in Marriage and Custody Rights

This reform, encapsulated in Federal Decree Law No. 41 of 2024, emphasizes child protection, parental rights, and more equitable solutions for families.

Key Reforms

  1. Stricter Penalties: The law enforces harsher penalties for child abuse and neglect, with fines ranging from Dh5,000 to Dh100,000 for various offenses, including unauthorized child travel and inadequate parental support.
  2. Inclusive Scope: The law applies broadly to UAE citizens and residents, with provisions for non-Muslim citizens and residents to opt for alternative legal frameworks, ensuring that personal matters are governed by appropriate laws.
  3. Marriage Regulations:
    • The minimum marriage age remains at 18. However, special approvals are needed for marriages with significant age gaps.
    • Expatriate Muslim women can marry without guardian consent if their home country permits it.
  4. Custody Rights:
    • Custody now extends to age 18, allowing children aged 15 and older to choose their custodian.
    • Mothers’ custody rights have been significantly enhanced, providing stability during crucial developmental years.
  5. Travel Rights: Both parents can now independently travel with their children, reducing conflicts and ensuring equal rights in post-divorce situations.
  6. Engagement Disputes: New guidelines address financial disputes from broken engagements, mandating the return of significant gifts unless specified otherwise.
