A pressing question arises: Can banks withhold end-of-service benefits to recover unpaid debts?
Understanding Loan Agreements
In the UAE, personal loans often come with specific contractual obligations. According to provisions set forth by the Central Bank of the UAE, personal loan agreements may contain clauses requiring borrowers to authorize their employers to credit their salaries and end-of-service benefits directly to the lending bank.
This is designed to secure the lender’s interests throughout the loan period.

The Legal Framework
Article 2(1) of the Securities and Documentation of Personal Loan Agreements stipulates that a borrower must provide a letter from their employer, ensuring that both salary and end-of-service benefits are transferred to the bank.
This means that upon leaving a job, the bank may have the right to claim these funds if there are outstanding balances on loans.
Implications of Employment Termination
Furthermore, banks can demand immediate repayment of the loan if they perceive any risk that the borrower may struggle to meet their obligations—such as losing their job.
Article 4(6) of the Personal Loan Agreements outlines that the loan becomes due immediately without prior notification if certain conditions arise, including job termination.
For those resigning with unpaid debts, it’s crucial to understand that banks in the UAE may indeed withhold end-of-service benefits to cover outstanding loans.
Borrowers should be proactive in managing their finances and consider seeking legal advice to navigate this complex landscape.
As the financial climate continues to evolve, staying informed about one’s rights and obligations is essential for all employees.
